NEW DELHI: The Delhi Police has added Section 201 of the Indian Penal Code (IPC) against chief minister Arvind Kejriwal‘s aide Bibhav Kumar in connection with AAP MP Swati Maliwal‘s assault case.
This section pertains to “causing disappearance of evidence of offence, or giving false information to screen offender” and carries a provision for imprisonment of one-sixth of the punishment awarded for the biggest offence in the crime.
Kumar was initially charged under various IPC provisions, including criminal intimidation, assault or criminal force on a woman with the intent to disrobe, and attempt to commit culpable homicide, in the FIR registered on May 16.
Maliwal alleged that Kumar attacked her with full force, slapped and kicked her when she had gone to meet Kejriwal at the chief minister’s official residence on May 13.
Investigations revealed that Kumar’s mobile phone was found to have been formatted when he was arrested from Kejriwal’s residence on May 18, after returning from Mumbai.
Despite being taken to Mumbai twice by the police, Kumar did not disclose the place where he formatted his phone or the person with whom he shared the data, and did not cooperate during his police custody, according to a senior police officer.
Another police officer mentioned that three CCTV DVRs (digital video recorders) were collected from Kejriwal’s residence – two from cameras installed at the entrance and one outside the drawing room. These DVRs were sent to the forensic science laboratory due to suspicions of tampering, and the reports are awaited.
Currently, Kumar is lodged in Tihar jail following his arrest on May 18.
